The seller will not be offering a refund, the seller is obviously a fraud as evidenced by his other auctions (see thread on chipboard regarding chip sets).

It may be that the account was hijacked from an honest Ebayer which would explain the previous good feedback.

Vegasplayer -- How did you pay? If by Paypal go to the paypal site and file a complaint now. Ebay makes you wait 30 days, but with paypal you must file before 30 days. If you paid by a check stop payment on it. If by moneyorder go to the issuer and ask how to stop payment for fraud.
